The issuer/operator is Fritz Berger GmbH, Fritz-Berger-Str. 1, 92318 Neumarkt, Germany (hereinafter referred to as Fritz Berger). Any consumer over the age of 18 can participate in the Fritz Berger advantage card bonus programme. Employees of Fritz Berger GmbH and entrepreneurs are excluded. According to § 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. Pursuant to Section 14 of the German Civil Code, an entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.
By applying to register as a participant, you recognise these General Terms and Conditions of Participation. The application form must be filled out completely and truthfully in the mandatory fields, signed and handed in at a Fritz Berger branch. Online registration is possible at www.Fritz-Berger.de. Once your application has been approved, we will send you your Fritz Berger advantage card by post or hand it over to you directly with this application in the branch. The advantage card is for your personal use only and is non-transferable. There is no entitlement to participate in the bonus programme. any changes to the data provided in the application form must be notified to us immediately in writing to Fritz Berger GmbH, Fritz-Berger-Str. 1, D-92318 Neumarkt or by e-mail to service@fritz-berger.de.

Collecting and redeeming the bonus
With every purchase at Fritz Berger [online order at www.fritz-berger.de, Fritz Berger shops and written (letter, e-mail) orders from the Fritz Berger catalogue], the value of your purchase (calculated sales price of the items purchased after deduction of any discounts and bonuses granted, excluding shipping costs) will be credited to your advantage card bonus account. Excluded from the bonus programme are purchases from Fritz Berger via sales platforms that are not operated by Fritz Berger, such as Amazon or Ebay, as well as sales at partner companies and the purchase of gift vouchers. When shopping in the shop, you must show your advantage card before paying. When shopping in the online shop, simply enter your login details! If a purchase contract is cancelled in whole or in part, the cancelled value of the goods will be charged back to your Vorteilskarte bonus account. you can obtain information about the current amount of your turnover at any time via our contact form, on the Internet at www.fritz-berger.de under "My account" or in any Fritz Berger shop.
Up to € 99.99 calendar year turnover -> no bonus
from € 100.00 calendar year turnover -> 3% of the calendar year turnover
from € 1,000.00 calendar year turnover -> 5% of calendar year turnover
Example: Your calendar year sales 2019: € 1,749.95 -> your bonus voucher: € 87.50. a voucher will be issued for the bonus to which you are entitled and sent to your address by mid-March of the following year. The bonus voucher is valid until 31 December of the same year in which you received the voucher. The voucher can be redeemed at any time when shopping at Fritz Berger (online orders at www.fritz-berger.de, Fritz Berger shops as well as telephone and written (letter, fax, e-mail) orders from the Fritz Berger catalogue). Redemption via shopping platforms is not possible. There is no entitlement to cash payment of the bonus/voucher amount. If you wish to raise any objections to our statement, please send them to us in writing, enclosing the relevant copies of the invoice/receipt and the original voucher, within 3 months of receiving the bonus statement/voucher. You will be informed of this separately in the bonus statement. Unfortunately, we cannot recognise late objections. Please store your vouchers as carefully as cash, as we cannot replace lost vouchers.

Voluntary 100-day right of return
The voluntary right of return applies to all items that you have ordered from us in our online shop at www.fritz-berger.de, in the Fritz Berger branches or in writing (letter, e-mail). The period is 100 days and begins on the day after receipt of the goods. You can exercise this right by returning the items to a Fritz Berger shop within 100 days or by sending them back to us, whereby the timely dispatch of the items is sufficient. Fritz Berger will bear the return costs for you. The voluntary right of return only applies to unused goods which you have only checked with regard to condition, properties and functionality, as is usual in a shop. In addition, the goods must be complete (including accessories and any instructions and instructions for use) and undamaged and must be returned or sent back in the original packaging as delivered. The voluntary right of return does not apply to the purchase of gift vouchers and not to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by you is decisive or which are clearly tailored to your personal needs. If you are entitled to a statutory right of cancellation (for contracts concluded outside business premises and for distance selling contracts), this is not affected by the voluntary 100-day right of return, but remains in full and unrestricted independently of this. Your statutory warranty rights are also not restricted by our voluntary right of return, but remain unrestricted.

Exchange of articles
Benefit card holders can also return all items purchased in Fritz Berger shops during the above-mentioned period for which the benefit card was presented at the time of purchase, even without the original receipt, and receive a refund of the purchase price paid. For this refund, we will use the same means of payment that you used for the original transaction.

Cancellation/termination of participation
You can terminate your participation in the Fritz Berger Vorteilskarte bonus programme at any time without notice as follows: By written notification by post to: Fritz Berger GmbH, Fritz-Berger-Str. 1, 92318 Neumarkt, Germany. By e-mail notification to service@fritz-berger.de. Fritz Berger GmbH is also entitled to partially or completely discontinue the bonus programme at any time.

changes to the bonus programme
Fritz Berger also reserves the right to change these general conditions of participation. you will receive written notification of the changes in advance at your registered address. If you do not object in writing to Fritz Berger GmbH within two months, the changes will be deemed to have been approved. Approval is also deemed to have been given if you have a new turnover credited to you after receipt of the amended conditions. You will be expressly informed of these legal consequences in the written notification of the changes. You are of course free to terminate your participation in the bonus programme at any time.

Loss of bonus card
If you lose your bonus card or if your bonus card is stolen, you are obliged to inform us immediately. In this case, you can apply for a replacement card free of charge.

Dispute resolution
We will endeavour to settle any disputes arising from our contract with you by mutual agreement. Beyond this, we are not obliged to participate in arbitration proceedings and unfortunately cannot offer you participation in such proceedings.
